Equity: The Landlord-Tenant Watchdog

August 19, 2010

What role does equity play in the landlord and tenant arena? What role, to ask a second question, should equity play in this important area of property law? This paper explores both of these questions and provides the interested reader with a full discussion of these two important legal / equitable questions. I commend the students who wrote this paper – it is full of valuable insights. Thanks.  As always, I invite comments. By the way, the bios of  these excellent students are also worthy of your reading.

Equity – Some More Law Review Articles & Materials

August 19, 2010

Every once in a while you get real lucky. Law School Professor Henry Smith, at Harvard Law School, is a brilliant scholar and (happily and luckily) a friend of mine. He has granted me permission to post his Equity Syllabus on Equity is Swell. If you look closely, you will find some of the leading law review articles in the country on a variety of equitable topics. I commend this syllabus to any interested reader and I can tell you (having read more or less all the articles in his course) that this gives you a broad deep rich background into a variety of topics that come up in the real world. Thanks, Henry – your permission to post this is very much appreciated. Spitz
